Refund policy
This policy is written in compliance with the Australian Consumer Law (ACL), which forms Schedule 2 of the Competition and Consumer Act 2010 (Cth) and applies to all sales made by Mobbly to Australian consumers.
Your rights under the ACL cannot be excluded, restricted or modified.
1. Your Rights Under Australian Consumer Law
Under the Australian Consumer Law, our products come with guarantees that cannot be excluded. You are entitled to a replacement, repair or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Acceptable quality means goods that are:
- Safe, durable and free from defects
- Acceptable in appearance and finish
- Fit for all the purposes for which goods of that kind are commonly supplied
- Match the description, sample or demonstration model provided
2. Our Change of Mind Policy
In addition to your statutory rights, Mobbly offers a voluntary change of mind return policy subject to the conditions below.
2.1 Eligibility
- You have 30 days from the date of delivery to request a change of mind return
- Item must be unused, unopened and in its original packaging with all tags and accessories intact
- Item must be in resalable condition — not damaged, scratched or modified
- Proof of purchase (order number or receipt) must be provided
2.2 Non-Eligible Items
The following items are not eligible for change of mind returns:
- Items that have been opened, used or removed from original packaging
- Screen protectors, earphones or hygiene-related accessories once unsealed
- Items purchased on sale or clearance (unless faulty)
- Items damaged by the customer after delivery
2.3 Change of Mind Return Process
- Contact us at returns@mobbly.com.au with your order number and reason for return
- We will provide a Return Authorisation (RA) number within 2 business days
- Return postage costs for change of mind returns are at the customer's expense
- Once received and inspected, a refund will be issued within 5 business days
- Refunds are issued to the original payment method only
3. Faulty, Damaged or Incorrect Items
If your item arrives faulty, damaged in transit, or is not what you ordered, you are entitled to a remedy under the Australian Consumer Law at no cost to you.
3.1 What We Will Do

3.2 How to Report a Faulty or Incorrect Item
- Email returns@mobbly.com.au within 30 days of delivery
- Include your order number, description of the issue and clear photos where applicable
- We will respond within 1–2 business days with next steps
- Do not return items without first receiving a Return Authorisation (RA) number from us
4. Refunds
4.1 How Refunds Are Processed
- Refunds are issued to the original payment method used at checkout
- Credit card refunds: allow 3–5 business days to appear on your statement
- PayPal refunds: typically processed within 1–3 business days
- Afterpay / Buy Now Pay Later: refund issued to the provider who will adjust your payment plan
4.2 Partial Refunds
A partial refund may be issued where:
- Only part of an order is returned
- An item is returned in a condition that reduces its resale value (change of mind returns only)
- Original shipping costs are non-refundable for change of mind returns
4.3 Restocking Fee
Mobbly does not charge a restocking fee for any returns.

6. Warranty
All products sold by Mobbly carry the statutory warranty protections under the Australian Consumer Law. In addition:
- Most accessories carry a minimum 12-month manufacturer warranty against defects in materials and workmanship
- Warranty does not cover damage caused by misuse, accidental damage, water damage (unless item is waterproof rated), or normal wear and tear
- If a product fails within the warranty period due to a manufacturing defect, we will repair, replace or refund at our discretion
To make a warranty claim contact returns@mobbly.com.au with your order number, description and photos of the defect.
7. Disputes & Escalation
If you are not satisfied with the outcome of your return or refund request:
- Contact us directly at support@mobbly.com.au — we aim to resolve all disputes within 5 business days
- If unresolved, you may contact NSW Fair Trading on 13 32 20 or at fairtrading.nsw.gov.au
- You may also contact the Australian Competition and Consumer Commission (ACCC) at accc.gov.au
- For online purchases you may also lodge a complaint with the relevant ombudsman service

IMPORTANT NOTICE: This policy does not limit or exclude any rights you have under the Australian Consumer Law. Statutory consumer guarantees apply regardless of this policy and cannot be waived. If there is any inconsistency between this policy and the ACL, the ACL prevails.
